Limitation of Liability

To the maximum extent permitted by law, digitanovae shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability to you for all claims arising from or relating to these Terms or our services shall not exceed the amount paid by you to digitanovae in the twelve months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify, defend, and hold harmless digitanovae and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cyprus. Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Cyprus.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.

Termination

Either party may terminate the service relationship at any time with written notice. digitanovae may immediately terminate or suspend your access to our services if:

  • You breach any provision of these Terms
  • You fail to pay fees when due
  • Your use of our services poses a security risk
  • We are required to do so by law or regulation

Upon termination, your right to use our services will cease immediately, and we may delete your data in accordance with our data retention policies.

Force Majeure

digitanovae shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, or technical failures of third-party systems.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

Changes to Terms
